K so I'm sitting at home, and we get this call on the phone, it's not a number i recognize so I dont answer (we always screen calls). The guy tries again 10 times within 5 minutes to reach us.The last time he calls saying that if we do not pick up our phone he will sue us. I have it on the answering machine... is this legal? I called the number back livid after that and said the number was unavailable. If he calls again Im am tearing this man a new a**hole. He was such an a**hole about it. Saying "this is a curtousy call, if I do not get a call back soon I am going to SUE you" (hard enpahsis on the "sue").

So I did some research online of this company, apparently they are some company in Texas that calls trying to make a quick buck of phony collections. I seen on one website a man who use to work there put this...

Quote
I will tell you all the TRUTH about this company because I currently work there.

They have 50-60 phone desks about 4 feet apart from each other in 2 large rooms adjoined by a small hallway. In 1 of these rooms, there is a large raised platform with a built in wall between it and the large sized room about waist high with 3 large monitors attached to the ceiling displaying call information about the sales employees current activity. The Owner, President and some other a**hole sit behind this wall.

Below them is approximately 25 employees on a dialer. This is the room calling businesses that they have no business in calling. The dialer is fed information that sales manager Jeff Buono obtains by purchasing call lists with owner names on them. Each sales employee has a headset, a computer, a stand with approximately 10 page long call scripts for everything they say. 98-99% of what they say comes from these scripts. They force each employee to call about 400-500 companies a day that are auto dialed by the dialer. They are encouraged to "scream at 'weak' business owners" to coerce them into giving away outstanding accounts which they assign to their collections dept in the other room immediately.

The sales ppl are given 4 or 5 things to say to overcome any objections and they instantly go back to the script. The script is designed for a 1 call close to get permission to collect on your outstanding debts for you for 33 to 50% fee. The sales people are beaten battered and bruised into this work, often unable to find other jobs, constantly told all day long that they will be fired and cursed at. They work on 2000 salary a month and they have to collect 20,000 in PAID fees(approximately 250,000 in new accounts/month to be collected on) per MONTH or be fired. Its like a f***ed up boiler room, if youve seen the movie... without the big money for the workers.

It is illegal for them to threaten to sue you or put liens on your property if they do not really intend to, swear at you, lie about who they are, etc. But many of them do just this. Some say they are with their attorney, others curse; they have a very effective script let me tell you. They are not allowed to swear at you and they often do.

One thing that makes them go crazy is when they hear about BBB complaints. So file a Better Business Bureau complaint against Haller, Harlan, and Taylor, which is their name, if these things happen and that will make them go berserk because each complaint will cost them. They are a ****en plague to mankind like HIV or some other disease. But they are outside regulations on the most part because debt collectors are given a lot of elbow room by govt. regulations. I have been looking for work for 2 months now and I still havent found anything... once i do, they can kiss my a** goodbye.

First thing I did after reading this was filed a complaint with the better business bureau. I'll be sure to tell them that next time they call! Haha, Ive read that a few people have been getting weekly phone calls from them for the past 2 years or so. If this happens to us, the law enforcement is getting involved. Thats just rediculous.

Has anyone else recieved a call from them? If you do in the future be sure to give them a piece of your mind!

Sorry to bring up an old topic but I recieved a interesting email the other day, from the company I'm talking about with this thread. Here's how it goes....

Hi

I found a post that you made on this site regarding a Collection Agency.

We are that collection agency and we are concerned about any matter that you may have with us that needs to be resolved.

Are there any outstanding issues? Additionally, please remove this post from this site as it is not snowmobile related and as such is a term of user requirement to have a memebership. Please we want to resolve this on a friendly basis. As a matter of legal requrement:

In law, defamation (also called calumny, libel, slander, and vilification) is the communication of a statement that makes a claim, expressly stated or implied to be factual, that may give a business, product a negative image. It is often, but not always, a requirement that this claim be false, and, or alternatively, that the publication is made to someone other than the person defamed. It is being published to the entire world via the website.

In common law jurisdictions, slander refers to a malicious, false and defamatory spoken statement or report, while libel refers to any other form of communication such as written words or images. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against groundless criticism. Related to defamation is public disclosure of private facts, which arises where one person reveals information that is not of public concern and the release of which would offend a reasonable person. "Unlike [with] libel, truth is not a defense for invasion of privacy."[2]

False light laws are "intended primarily to protect the plaintiff's mental or emotional well-being."[3] If a publication of information is false, then a tort of defamation might have occurred. If that communication is not technically false but is still misleading, then a tort of false light might have occurred.[3]

Please remove this from your website immediately. Please consider this official legal written notice as required by law. Failure to remove this information will constitute your unlawful action by assisting in the dispersing of this negative, untrue, false and misleading information regarding this company.

Govern Yourself Accordingly,

Brian Johnson
Legal Department
Haller Harlan & Taylor

Esentially these people are saying they are going to sue me if I dont retract what I say, well I'm here to say now that I meant 100% OF WHAT I SAID.

Does this company only call businesses or do they call residences because I would be interested in a call from them so I can just listen to their BS. Its rather fun to f**k with telemarketers.

How did they find it on this site? they must google their own name to count the complaints

Anyways, you are entitled to your opinion and IMO leave your post.

that many calls in a short period of time is actually actionable on your part. that is considered harrasment. i had a credit card company do that to me once i called an attorney. 20 minutes after i talked to the attorney they called again appologized to me and wiped my credit card balance. the attorney called them and threatened a lawsuit. if it happens again contact your states attorney referal services and speak to one.

This seems like a B.S. business to me. If they have had soooo many complaints to the Better Business Bureau, I wonder why they haven't been investigated? With what everybody here is saying, sounds like they're looking for a reason to sue somebody for slander or something. Let them call me, Bet they'll never call again!!! Probably teach them all a few new words!!!

this has somewhat happened to me before. my father continuously got a call from these people and they would say on the answering machine [we also don't pick up unfamiliar numbers]
"hello, this is "so&so" and i am letting you know that your car warranty is almost over!. this will be your last courtesy call. contact us at 1-800-***-****"
this started calling around 5 times a day. which i don't get since that says "last courtesy call".
well after about 2 weeks my dad got fed up with it and picked the phone up and completely b****ed them out. screaming, swearing, the works. luckily they stopped calling.
but don't take it to far, this kids dad i know got to angry and said he was "going to kill you" to the telemarketer. i guess he had to go to anger counseling.

good luck with our problem

Our shop got a call recently from a sales number and they asked "Is this Dave Spencer" and my dad replied to them yes. Then they started getting into all this other BS and on the next months phone bill we had a charge for almost 200 bucks on some features we never heard of. Come to find out after hours of bickering with the phone company, the sales that called us used my dads voice of him saying "Yes" to his name was dave, they took that clip and inserted it into them asking if we accept these charges. So watch out when you get sales calls dont agree to anything. They will find anyway to royaly EF you.

We still get the Car warranty all the time here in my house about 10 or so calls a day. By the end of the day we are usually pretty livid.

How do we get it to stop? I get them atleast once a day on a different number everytime. Sometimes from a Nebraska number sometimes a south dakota number. It's getting really old. My truck hasn't had a warranty in 2 years so why would I want one now? I bet if you signed up for one they would STILL be calling you and giving you that message. What a joke.

know any lawyers? in Michigan im pretty sure its illegal for them to threaten you. also that many calls in that short of a time is harassment like someone else stated. you would have had to call the cops get a report filed, then have the court system take action as to getting phone records and what not. it would take alot of time and legal help and most of all money.

i get the car warranty one all the time at work. if you tell them that hey this is a business take us off your calling list they just hang up on you, so they did "hear" you and don't have to take you off the list. its fun to mess with them some times, go along with it, "o really its gonna expire soon? hell that Mitsubishi company is sure nice for warrantying my car for 16 years, i should renew it huh?" then tell them were to shove it. hopefully it got their hopes up that i was gonna fall for it and then i crushed them lol.

Well every since I sent them this email, they havent called or emailed me.

Quote

Are you trying to say your going to sue me if I don't retract what I said about your company? That is redicuous, I'm informing my friends on a website about a company that was EXTREMELY rude. Not to mention we are still getting calls from your company when we have already payed the company. We paid the company a week before we even recieved the first call from your company on the 19th. LEAVE MY FAMILY ALONE. The debt has been paid and all is well, now take us off your list and NEVER call my family again. These calls are on the verge of harrassment. The courts look at a few different things when it comes to harrassment, as a lawyer of a company you should know these things...

Is the respondent (the person who is harassing you) contacting you or are you contacting each other?
Yes, the contact is only one way, except for this one email.
Has the respondent been clearly told that you do not want any further contact?
I believe this email clearly states that we do not want any further contact with you.
Is the respondent’s behavior alarming, annoying, or harassing you?
Annoying beyond all belief, harrasing and rude as well.
Are the respondent’s actions interfering with your privacy or creating an intimidating, hostile, or offensive living environment for you?
I believe saying you'll sue us qualifies this as being intimadating as well as hostile.
Has the respondent’s contact with you been previously limited by a court order?

No it has not.

So now that we settled that, and seen that this can easily be taken to the court as a harrasment charge, lets just leave each other alone and no legal action on either end will happen. The debt is paid, it is done with.

So I'm not sure if this stopped the calls or not. But I called the better bussiness bureau about them. Heard companies love that haha.
