It doesn't matter if it was down hill or or if he got clocked right after the sign.
Doesn't your state have warning signs? You need to be down to the limit before you pass the sign.
You could fight it, I don't know what the courts are like around there so I cant predict the outcome but there is no reason he deserves to have it dropped of reduced.
Some states require a reduced speed sign be in place whenever the speed drops 10 miles per hour or more and if the speed drops from 65/55 to something less than normal highway speed. Most of those also have a distance requirement for the placement of the warning sign. About the only way to get out of a speeding ticket would to be able to prove that the sign was in the wrong place. This happened in my hometown area. The sign had been in the same place for many years-until somebody had a bug up their rear and researched the statue. That sign got moved real quick.
But if your state does not have that requirement, your brother should stand up on his two hind legs and take it like a man.

It's probably more trouble than it's worth for your brother to fight this. It's his word against the officer, and who do you think the judge is going to side with? Plus he was the dumba$$ for having passengers in the car with a provisional license... If the parents were busy, they could have waited to get the kid home, that excuse won't fly in a court room. Your brother should just pay the fine and be a man about it.
I hope I die like my grandpa did - quietly in his sleep... not like the rest of the people in the car.

laws are just there to keep everyone safe. theres a reason for the speed limit.

Here in Ontario the traffic court system is kind of out of whack.
Its worth it to fight any ticket that has demerit points or a large fine.
You set the court date, then when you arrive they will offer you a deal. The deal is usually for reduced points and fine. Should you accept you are brought before the judge to plead guilty and receive you reduced charge.
If you don't accept, a new court date is set up. But unless you have a really good reason why you should be found not guilty I don't see it happening.
Its always crazy backed up in there. And you have to listen to all the idiots that try and change their mind, don't have a clue what the judge is saying because he is speaking proper English.......or just straight up don't have the first clue whats going on in their life.
