what are the charges?
- someone is trying to sue me so my dad wants to counter sue.

ok, so what has happened is this kid who is a freshman {i am a sophomore}, i have been told has been talking about me a lot. he has been saying a lot of stuff is what people have been telling me. so i have tried to just ignore it, thinking he is just a freshman who wants to feel like a tough guy.
then after a couple more months people keep telling me he just doesn't stop. so i actually just decided to ask him, instead of just calling him out, if he has been talking about me. so on the bus i said "so-so, have you been talking S***?". and he said
"no, why would i be?"
so i said what ever and just walked away. then while getting off the bus he says, while im going down the stairs "F***** P***Y" then ducks his head. "then i told him to shut his mouth" and got off the bus.
stuff like that went on for awhile then he wanted to fight me, so i went to this place where he told me to meet him and he never showed. what ever, i guess its over, wrong. he starts telling people that i never showed and that i was afraid of him and asked him not to do anything to me. i didn't even do anything after that, just told people it was BS, and gave him dirty looks and stuff.
then one day he IM's me on Myspace, asking if i broke his mailbox, which i didn't. then he starts telling me, that someone told him i did it but he wouldn't tell me who. so i keep asking him who said it and stuff and he calls a P****. then i say how he pansied out. and he tells me to fight him. so i said ill go down to the dirt parking lot next to his house and wait. i did, figureing it would just be another no show. then after 10 min. no show. so i call my brother and his friends to come pick me up. they come, and while pulling out of the parking lot, a cop pulls up.
the cop tells us to stay in the car and starts asking which on of us was Ari, who is me. so then she starts asking me about threatening to beat "so-so" up. then this kids grandfather pulls up in a truck and blocks us in with it. then he turns on his high beams in our faces. then his grandmother just runs up to my window and starts yelling at me saying, "so-so" told her about what i said about her. which is a total lie, i don't even know his grandmother. then the lady police officer begins yelling at the grandmother to get away from me, and she takes her to the back of the car to talk to her. while they were back there we look at the grandfather in his truck. and we see he is actually waving a bat at us, swinging it like he would be hitting us. but of course the police officer didn't see it, and when my brother says he waved a bat at us the police officer yells "get back in the car right now or ill arrest you!" then just normal name taking stuff like that goes on and we go home.
now, today about a week later, after having to change buses because he is on my bus, and being told i have to avoid him no matter what, i get a note from the police saying i am getting sued for threatening, and planning on committing a crime. we plan on counter suing the grandfather though for threatening minors with a deadly weapon.
sorry for all that rant, i was just so angry about it. do you think they will drop the suit so there grandfather doesn't get convicted? do you think he will even get convicted? is this really my fault? am i at wrong here?
and yes i do realize i should have just ignored it from the beginning. i just didn't think that it could ever escalate into something this big.
just tell me what you think will happen, because i have no clue which way this is gonna go.

sounds to me you shoulda just beat the piss out of him on the bus but he'll lose the trial if you can prove hes been harassing you

i believe the police have the IM, but they said i worked up to the fight with it, because i got angry at him.
also i have at least 5-10 people who all say he was saying stuff about me, and he would say stuff while getting off the bus.

If you are being sued for something. You had better know what it is for. What did the letter say. It will tell you what charges and $$$ factor they are looking for in the suit.
Anyone can get a temporary restraining order, but it takes a hearing for it to stick

ya, but i don't care about him getting in trouble or anything. the big deal is me getting in trouble, colleges are notified of this stuff right? so when i apply i don't really want a crime to on there. it just says that the police have applied that i have been acused and will be tried for:
"threatening to commit a crime"
then the rest just says when the court date is, and where.

1. Should have realized it is kid stuff and not even talk to the kid. Should have never asked him if he was talking ****. Who cares if he was. In 10 years, you will have a hard time even remembering his name. You will only remember him when you see him pumping your gas.
2. Since when can someone sue for such a stupid thing? If someone threatens someone about beating them up, that is harassment and is a police mater (restraining order and what not)... at least in my opinion.
3. If you are actually getting sued, you should get a lawyer and deal with your countersuit there. But I don't get how all this sueing can take place when no fists or bats were thrown.

I know from law class that two people can fight if they both have consent and i dont really understnd how youcan be sued/charged for "threatening to commit a crime" When he was the one who wanted to fight you. I also don't understnd how the police can say that you worked up to it whe he ws the one chirpin you behind your back.

Sounds like a lot of 'he said', 'she said' to me. You have your friends who will back you up and he has his who will back him up. Like always, there are two sides to every story. I bet it will be seen as two kids being kids and dropped or someone will get a slap on the wrist. Good luck either way.

And theres also the whole "beyond a resonable doubt" If you ask me theres way too much doubt for anyone to get sued or charged, IMO. But good luck.

hey, that Fer set u up, what he did was pi>?ed you off, and when you IM'ed him he copied the stuffe he wanted and put it on a word document. I know all about this, this happened to me to, but they tried to sue me but they ended up losing a grand when i countersued. I learned my lesson and that kid is not at my school anymore, if i were you i would just work out a deal with the kid, and if you want to make them mad press the charges on the Grandpa

im with triple fever also as for getting kicked out of school its actually pretty hard i know a kid who has been in 4 fights and absolutely murdered the other kid and he hasnt been expelled lol they must like the entertainment

I got in fights as a kid, but I don't ever remember even considering on telling on one another let alone bringing the law and Grandma and Gramps' into it. 
This kid must have fabricated one heck of a storie to get his Grandparents that upset. Your Dad will handle it well I'm sure. Just follow your parents advice.

A judge is going to look a this case and laugh. He is going to say it's kids being kids. The judge should drill the grandfather on why he brought a bat to beat on kids. You were setup, the kid took parts of the IM to turn it on you. He called the cops saying you were going to kick his ass and you were by his house. He gave the IM's to the cops, to make himself look good. You need to see the so called IM's the cops have. You should be able to, if it's evidence against you. If anything the judge will put restraining orders against you guys. With the exception of school, where one of you open your mouths, and can be charged with braking the order.
"threatening to commit a crime" how? Because you showed up to a spot to fight? Have you gone in and talked to the police about this? To see at what point of this, they can sue you? I have never heard of the police sending out letters when you are getting sued. They come from a lawyer, or court system. I'd then counter sue the grandfather and grandmother for the samething. It may only take a letter from your laywer, and they may change their mind. If they do, then you get a restraining order against the kid first, if not now. Sounds like a weak move, but this kid is going to just keep calling the cops, and keep doing shady ****. You will be the one getting blamed everytime.
If it were me all this b.s would of stoped on the bus. I'm glad when I was growing up, you knocked the **** out of each other, and the b.s and games were done after the fight. Everyone is to F'in sue happy, it makes me sick.
