what are the charges? - someone is trying to sue me so my dad wants to counter sue. started by 87srvsnow

i completely understand. and i hope that they just drop the charge. i would have fought him on the bus, but then i would have been kicked off the bus, and suspended from school. i would have had to find my own ride home since i wouldn't be aloud on the bus anymore, just a lot of BS then just for one loser.

i don't like suing his grandfather, and i somewhat understand him swinging the bat, somewhat. he just wanted to protect his grandson. its just i don't want to get charged with anything, so i have to try something so they'll drop the charges.

What they got was a summons. It depends on the state and how much money the plaintiff is asking for. Some go through local law enforcement and others, the plaintiff pays the lawyer to serve the papers.

Did you get the cop to look into grandpa's vehicle? If she did not see he bat...you have a tough row to hoe there. You need the complete IM. Both for they court case and afterward. If your dad wins the case, give the IM to school and have that kid put on another bus. It will be the start of your case of harrassment against him.

There was NO REASON for an adult to be making threatening gestures with a bat. NONE!! If I was your dad, I would ask the cop what comments grandma made toward you. And then sue her too.

Hopefully, you learned a lesson here. Words can't hurt you. Now, you have to go out of your way to prove you are a good kid.

No I know you did the right thing on the bus. Don't listen to me about the bus. Thats why I had to take the nike express home, when I got tossed off the bus in jr high for a few months.

Just find out the facts from the police and go from there.

WOW if i was you, that kid woulda got a punch in the face. he called you out, big deal you get suspended. the thing with the grandparents WTF???? like i would go tell my grandparents about some kid at school wanting to fight me. this kid isnt worth all that, getting sued? WTF again. thats the stupidest thing ive ever heard. kids fight all the time big deal. if he says anything to you, anything at all punch him in the face. if you get suspended or w.e big deal. all you gotta say is he asked for it LOL but anywho good luck with that **** sounds like its gona be fun.

but if i did fight him then i would definatly go on pobation, and it doesnt look good on college aplications that i kicked someones a**. its not worth not going to a god college just because one kid decided to act tough.

Just remember a IM won't hold any weight in a court room, No way they could ever prove who is behind the screen name. So they really have nothing, it's just a big waste of time the charges will be dropped once they see how much court really costs.


And colleges only see what you send them and I doubt you would be sending them your juvenile record. Most of the time they are sealed anyways when you turn 18 (If you have one)

You're applying for college, not a job. College acceptance depends on your academic performance. There is no criminal records check; your acceptance depends on your transcript and how well you promote yourself.

It's been 8 years since I filled out college applications, but I don't remember there being a "Have you been convicted of a crime" checkbox. Even if there was, they can't deny you just because you have a record, just like a job. Universities want your money, and you'll be giving them a bunch of it. They aren't going to say no just because of some stupid stuff you did as a kid.

thats the thing! everyone hates this kid! he talks s*** about everyone, and everyone hates him. this is like the third time this kid has called the police about people wanting to fight him. (i didn't know this prior to going to fight him). i don't get it how even his parents could take his side. either everyone in school is an a**hole or he is. and im normally a person who wouldn't fight someone, so he is the only common denominator here.

also, my friends said that they will be witnesses to this kid being a prick, but the court date is on a thursday, at 9 AM. everyone is in school! how can i even bring witnesses? a couple people said they'll come but some cant miss school.

thanks, that was actually my biggest fear, i didn't want to not go to the college i wanted just because i decided to make a mistake early in life. this actually just calmed me down a bit haha.

Get a lawyer and have him sepenia anybody that was a witness. That way they CAN get out of school. Also, like said before, ask the police to see a copy of the report (a few bucks) and the messages from the other kid. It's your right to see these.

I've had a case years ago that was worse then this and got a lawyer involved and low and behold, stories changed. They knew I was serious.

What's happening in the world today?? Use to be that we'd beat the sh!t out of each other and got nothing...times are a changin', I guess.

yup there changing for the worst. sadly my generation seems to be the beginning of a generation of total tools and wimps. oh well people can raise there kids anyway they want i guess. i know ill be raising my kids to put there money where there mouth is. if you plan on saying something, you better plan on backing it up.

i thought about the lawyer thing but lawyers are expensive though.

None of this will stick in court. There's no way that the IM was saved from MySpace. If it was, it'll have his side where he egged you on as well.

Basically it's a bunch of heresay. Without witnesses to prove a story of "well he said this," it's normally thrown out.

Don't worry about college applications. If you do have charges convicted, they'll be simple and more than likely off your record once you turn 18.

And just to clear up, you're not being sued. If you got a summons to a criminal court, you have charges being pressed against you. If it's a civil summons, and they're demanding money, that is a suit. Sounds to me like it was a criminal summons.

Talk to a lawyer. They're not all sleazebags, and will more than likely either help you out or give you some solid advice on where to turn from here.

haha i have thought about it. one thing i have noticed that everyone including all my friends says is why i didn't just beat him up at school. i don't really see a point to fighting in school. three punches, and then teachers are breaking it up. three punches in and im not even sure if the person has learned a lesson yet.

Its all hear say even if they have an im conversation. Unless you really threatened him seriuosly and they have nothing against him I would not worry about it too much. If it really does come down to going to court get a lawyer and have him talk to the judge/prosecuter and let them know you dont want this to build up any bigger than it already has. Let them know you just wanna graduate and go to college and you are willing to appologize and or just stay out of his way. Countersuit is not gonafly they never saw the bat and again its hear say or per say "he said she said". Good luck man stay out of trouble its alot easier in the future. I'm still haunted by some of the mistakes I made as a kid even though I think they are minor people that may interview you later on may not think they are so small but a possible pattern.

He's just trying to get you worked up, testing you what you would do about it, I bet those are phoney charges.

haha i have thought about it. one thing i have noticed that everyone including all my friends says is why i didn't just beat him up at school. i don't really see a point to fighting in school. three punches, and then teachers are breaking it up. three punches in and im not even sure if the person has learned a lesson yet.

what 3 punches boy it only takes one just aim for the back of the head and try doing it by going through his nose
